Welcome to Mallient. These Terms of Service ("Terms") govern your access to and use of Mallient's luxury lifestyle management services, including our concierge services, premium credit card products, exclusive experiences, and related services (collectively, the "Services").
By accessing or using our Services, registering for an account, or joining our waitlist, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
These Terms constitute a legally binding agreement between you ("Member," "you," or "your") and Mallient, Inc. ("Mallient," "we," "us," or "our").
Mallient provides luxury lifestyle management and concierge services designed to simplify your life and provide access to premium experiences. Our services include, but are not limited to:
Mallient offers a portfolio of premium credit card products with exceptional rewards structures tailored to different lifestyle archetypes. Credit card services are subject to approval and additional terms provided during the application process.
We strive to provide 24/7 concierge support to our members. However, we reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. Certain services may have limited availability based on membership tier.
To become a Mallient member, you must:
Mallient offers multiple membership tiers (Mallient and Mallient Elite) with varying benefits, service levels, and fees. Elite membership is invitation-only and subject to approval. We reserve the right to decline or terminate membership at our sole discretion.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breach.
Membership fees are charged on a recurring basis (monthly or annually) depending on your selected plan. Fees are non-refundable except as required by law or as expressly stated in these Terms.
Certain concierge services may incur additional fees beyond the membership fee, including but not limited to:
We will obtain your approval for any significant additional charges before proceeding with a service request.
By providing payment information, you authorize Mallient to charge your designated payment method for all applicable fees. You agree to maintain valid payment information and promptly update it if it changes.
If a payment fails, we may suspend your access to Services until payment is received. Continued failure to pay may result in termination of your membership.
When you submit a concierge request for reservations, bookings, or other services, you authorize Mallient to act on your behalf to secure the requested services from third-party providers.
While we use our best efforts to fulfill your requests, we cannot guarantee availability or specific outcomes. Certain high-demand reservations, exclusive events, and services may have limited availability even for our members.
Services provided by third-party vendors (restaurants, hotels, airlines, event organizers) are subject to their own terms, conditions, and policies. Mallient is not responsible for the quality, availability, or performance of third-party services, though we carefully select our partners.
For best results, please submit non-urgent requests at least 48-72 hours in advance. Same-day or urgent requests are accommodated when possible but may be subject to additional fees and limited availability.
You may cancel or modify service requests by contacting your concierge as soon as possible. Cancellation policies vary by service and vendor:
You may cancel your Mallient membership at any time by contacting Member Services. Cancellations take effect at the end of the current billing period. Membership fees are not prorated or refunded for partial billing periods.
Repeated failures to honor reservations or attend booked services may result in fees charged by vendors, which you are responsible for paying. Habitual no-shows may result in service limitations or membership termination.

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the property of Mallient or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.
The Mallient name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Mallient. You may not use such marks without our prior written permission.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes only.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Mallient does not guarantee that Services will meet your requirements, be uninterrupted, timely, secure, or error-free. We do not guarantee the availability of specific reservations, experiences, or outcomes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MALLIENT BE LIABLE FOR:
Mallient acts as an intermediary facilitating access to third-party services. We are not responsible for the acts, omissions, quality, or performance of restaurants, hotels, airlines, venues, event organizers, or other third-party providers.
You agree to indemnify, defend, and hold harmless Mallient, its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
We reserve the right to suspend or terminate your access to Services immediately, without prior notice or liability, for any reason, including but not limited to:
Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
If you have a dispute with Mallient, please first contact Member Services at support@mallient.com to attempt to resolve the issue informally. We are committed to addressing your concerns promptly and in good faith.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New York, NY, and judgment on the award may be entered in any court having jurisdiction.
You agree that any arbitration or proceeding shall be limited to the dispute between you and Mallient individually. To the fullest extent permitted by law, no arbitration or proceeding shall be joined with any other or proceed on a class, consolidated, or representative basis.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice on our Services at least 30 days before the changes take effect. We will also update the "Last Updated" date at the top of these Terms.
Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must discontinue use of the Services and may cancel your membership.
These Terms, together with our Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and Mallient regarding the Services.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Mallient's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your membership without our prior written consent. Mallient may assign these Terms or any rights hereunder without restriction.
Mallient shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, pandemics, labor disputes, or government actions.
